The definition of a distance contract is given in the Law No. 6052 on Consumer Protection and in Article 4 titled "Definitions" of the Regulation on Distance Contracts No. 29188.
Distance contracts are contracts established between parties using remote communication tools, within a system designed for the remote marketing of goods or services, without the simultaneous physical presence of the seller or provider and the consumer, from the moment the contract is concluded until and including the moment of its conclusion.
According to the law, the Consumer has the right to withdraw from the contract within fourteen (14) days without giving any reason and without paying any penalty.
It is sufficient that the notification of the exercise of the right of withdrawal is sent to the seller or provider within this period.
The seller or provider is obligated to prove that the consumer has been informed about the right of withdrawal. If the consumer is not properly informed about the right of withdrawal, they are not bound by the fourteen-day period for exercising this right. In any case, this period expires one year after the expiration date of the withdrawal period.
The consumer is not responsible for changes or deteriorations caused by the customary use of the goods within the withdrawal period.
For a product to be eligible for return by the consumer, the product packaging and its contents must be undamaged, and the product must be in a condition suitable for resale as new.
Once the packaging is opened by the consumer, returns are only possible in cases where the goods are defective or incomplete. The original delivery receipt and sales invoice, as well as the second copy found on the shipping package, must be returned. Modesy is not responsible for any delays caused by the bank in the refund process. For the return process to be completed, the return form must be filled out completely. For products that are non-returnable due to their nature, the right to return single-use products is subject to the condition that the product packaging is unopened, undamaged, and the product has not been used. The provisions of consumer law apply regarding product returns.
In disputes arising from this registered contract, Modesy accepts, declares, and undertakes that its accounting records, electronic and computer records shall constitute valid, binding, conclusive, and exclusive evidence within the meaning of Article 287 of the Code of Civil Procedure, and that this article constitutes an evidentiary agreement. Modesy hereby waives in advance any right to object to its records and to offer an oath regarding their proper keeping. If you wish to cancel your order, you must do so within 14 days by sending a return email to the address provided on modesy.com.tr or by filling out a written form and sending it via fax or post.
